Description

9. APPROVAL OF SALARY SCHEDULE AFFECTED BY THE CHANGE IN FLORIDA MINIMUM WAGE
Description
Due to an increase in the State of Florida's minimum wage the following salary schedule affected by the change is presented for approval. Steps 2 - 15 in the Food Service Assistant column have been adjusted accordingly.

EXPULSIONS

10. APPROVAL OF EXPULSION CASE NO. 12-168
Description
On November 9, 2011, the student listed in Expulsion Case No. 12-168, violated School Board Policy 5.34(1)(g), Fighting.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 13, 2013.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-168, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year, the 2012 summer session, until January 13 of the 2012-2013 academic year.

11. APPROVAL OF EXPULSION CASE NO. 12-204
Description
The student listed in Expulsion Case No. 12-204, is in violation of an accepted Expulsion Settlement Agreement for alternative school placement.  On November 29, 2011, the student listed in Expulsion Case No. 12-204, violated School Board Policy 5.32, Zero Tolerance, and School Board Policy 5.322, Prohibition Against Use, Sale, or Possession of Alcohol or Drugs.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County Schools until January 13, 2013.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case No. 12-204, to expel the student reference therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year, the 2012 summer session, until January 13 of the 2012-2013 academic year.

12. APPROVAL OF EXPULSION CASE NO. 11-466
Description
On April 26, 2011, the student listed in Expulsion Case No. 11-466, violated School Board Policy 5.34(1)(g), Graffiti and Use of Profanity.  It is the recommendation of the Superintendent that the student be expelled from the Sarasota County School until June 6, 2012.

Recommendation
That in accordance with provisions of Sections 1006.07(1)(a)(b), Florida Statutes and School Board Policy 5.34, and the holding of a hearing having been waived by the student/parent, the recommendation as specified in Expulsion Case 11-466, to expel the student referenced therein from the Sarasota County Schools, be approved effective immediately for the remainder of the 2011-2012 academic year.

13. APPROVAL OF EXPULSION CASE NO. 12-193
Description

MATERIALS MANAGEMENT

14. APPROVAL TO AWARD BID #12-0108 FOR COMMERCIAL KITCHEN REFRIGERATION MAINTENANCE AND INSTALLATION SERVICES
Description
A bid to provide 'Commercial Kitchen Refrigeration Maintenance and Installation Services' was received on December 14, 2011.  The bid of Linc Services, LLC, was the best low bid and met the advertised specifications.  This bid is for a period of two years with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the transfer from capital funds allocated to the Facilities Services Department.

Recommendation
That the bid of Linc Services, LLC, to provide 'Commercial Kitchen Refrigeration Maintenance and Installation Services' in an amount not to exceed $350,000, be approved for award and purchase.

15. APPROVAL TO AWARD BID #12-0171 FOR HVAC MECHANICAL SERVICES
Description
Bids to provide 'HVAC Mechanical Services' were received from five vendors on December 13, 2011.  The bids of Total Building Solutions and United Mechanical, Inc., were the best low bids meeting the advertised specifications.  The bid of Boyd Brothers Service was non-responsive to the requirement to provide a Class A license.  The bid of Air Mechanical and Service Corporation was non-responsive to the requirement for mechanical services to be the primary business of the vendor.  This bid is for a period of one year with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the transfer from capital budget allocated to the Facilities Services Department.

Recommendation
That the bids of Total Building Solutions and United Mechanical, Inc., to provide 'HVAC Mechanical Services' in an amount not to exceed $250,000, be approved for award and purchase.

16. APPROVAL TO AWARD BID #12-0110 FOR HVAC FACTORY CHILLER SERVICE AND OEM REPAIR PARTS
Description

Bids to provide 'HVAC Factory Chiller Service and OEM Repair Parts' were received from two vendors on December 14, 2011.  The bids of McQuay Factory Service and Tampa Bay Systems Sales, Inc., dba Tampa Bay Trane were the best low bids meeting the advertised specifications.  This bid is for a period of one year with the option to renew for two additional one-year periods.  The funds for these purchases are contained in the transfer from capital budget allocated to the Facilities Services Department.



Recommendation
That the bids of McQuay Factory Service and Tampa Bay Systems Sales, Inc., dba Tampa Bay Trane, to provide 'HVAC Factory Chiller Service and OEM Repair Parts' in an amount not to exceed $750,000, be approved for award and purchase.

Recommendation
That the bids of Air Mechanical and Service Corporation, All American Heating and Cooling, Inc., and D & D Mechanical Services of Florida dba Myakka Heating and Cooling, to provide 'HVAC DX and Light Commercial AC Systems Installation, Maintenance, and Repair Services' in an amount not to exceed $500,000, be approved for award and purchase.

18. APPROVAL OF CLASSIFICATION OF INOPERATIVE EQUIPMENT AND FURNITURE AS PROPERTY TO BE DELETED
Description
The custodians of the property (cost center heads) have certified it to be traded in on new equipment, unaccounted for, not repairable or otherwise inoperable. Property still on hand after reallocation will be salvaged for any useful parts and then sold at auction.   

Recommendation
That the classification of equipment and furniture, as property to be deleted, be approved.

CONSTRUCTION

19. APPROVAL OF CONTRACT FOR THE NORTH COUNTY TECHNICAL CENTER PHASE III (SCTI) PROJECT
Description

Under the terms of the May 15, 2007, (Item #47) Board approved "Agreement between Owner and Construction Manager for Pre-Construction & Bidding Services", the Director of Construction Services and a member of the Professional Services Selection Committee (PSSC) have successfully negotiated a contract with Willis A. Smith Construction, Inc. for the Construction of the North County Technical Center Phase III (SCTI) project.  This contract was negotiated on January 3, 2012.  The May 15, 2007 agreement included pre-construction and bidding services only.

This Contract for Construction includes the buildings and site work designed in this phase of the project.

The scope includes site development, building construction and renovation, demolition, retention area development along with construction of the Riverview High School baseball and softball fields.

The Guaranteed Maximum Price (GMP) of this contract is $25,865,707.00.  This contract is available for review at the Construction Services Department.  The School Board attorney has approved the use of this contract.  Funds for this contract are available in the project budget account.



Recommendation
That the Contract for Construction of the North County Technical Center Phase III (SCTI) project be approved as presented.

20. ACCEPTANCE OF CONSTRUCTION SERVICES' PROJECT COMPLETION AND APPROVAL OF FINAL PAYMENT TO CONTRACTOR FOR THE SARASOTA MIDDLE SCHOOL HVAC RENOVATION PHASE I PROJECT
Description
All work has been completed and all required close-out documents have been received from the contractor.  The final project costs have been internally audited and are enclosed herein in Change Order No. 7 for approval.  The Director of Construction Services has determined that the project is complete in accordance with state statutes.

Recommendation
That the project be accepted as complete and the final payment to contractor be approved as presented.

21. APPROVAL AND/OR RATIFICATION OF CONSTRUCTION SERVICES' CHANGE ORDER(S)
Description

The Construction Services' Change Order(s) are summarized on the enclosure for ease of review.  These change orders collectively total a decrease of $325,995.14 in gross contract dollars.

Included in these change orders are $254,655.56 credits for Direct Material Purchases; the corresponding Direct Material Purchase Orders of $240,146.75 result a net of $14,508.81 in tax savings.



Recommendation
That the Construction Services' Change Order(s) be approved and/or ratified as presented.

FINANCE

22. APPROVAL OF THE GENERAL FUND BUDGET AMENDMENT FOR THE 2011-2012 FISCAL YEAR
Description

The General Fund is being amended to reflect the Results of Operations through December 31, 2011 and the third recalculation of the Florida Education Program.  The budget amendment increases the unassigned fund balance to 13.55%.



Recommendation
That the General Fund Budget Amendment for the 2011-2012 fiscal year be approved as presented.

TRANSPORTATION

23. APPROVAL OF REQUEST TO PURCHASE THIRTY SCHOOL BUSES
Description

This purchase is a direct replacement of twenty-seven (27) regular a/c school buses and three (3) a/c lift buses in accordance with the fourteen (14) year replacement cycle and approved in the 2011-2012 Capital Transportation Budget.

Replacement will be thirty (30) of the worst condition buses that have high mileage and nearing the point of possible costly repairs, with new buses that get better fuel mileage and contain the newest safety equipment that will benefit child safety.

 



Recommendation

That the purchase of thirty (30) new buses to replace thirty (30) buses on the scheduled fourteen (14) year replacement cycle be approved as presented.




New Business
24. AUTHORIZATION TO FILE AMICUS BRIEF
Description
The amicus brief would support the right of a party to bring a legal claim asserting the State has not complied with the constitutional mandate found in the Florida constitution regarding the funding of schools and support the right of the judiciary to adjudicate such a claim.  The amicus brief would not address the merits of the pending adequacy suit.

Recommendation
That the School Board authorize counsel to join with the Sarasota Classified/Teachers Association in seeking permission for the School Board to file an amicus curiae brief in the Florida Supreme Court supporting the position of respondents in the case of Haridopolos v. Citizens for Strong Schools, Inc. should the Supreme Court accept jurisdiction of the case.

That the School Board authorize counsel to join with the Sarasota Classified/Teachers Association in seeking permission for the School Board to file an amicus curiae brief in the Florida Supreme Court supporting the position of respondents in the case of Haridopolos v.
